Canadian Fine Art Atelier Terms and Conditions

By commissioning a project with HEYDA, utilizing our services, or accessing our resources, you enter into a collaborative partnership governed by these terms. This agreement defines the mutual responsibilities of our Atelier, the clients, and all visitors to heyda.ca. These standards clarify expectations regarding the goods and services provided, ensuring a seamless journey from initial contact to final delivery.

1. Collaborative Process

To ensure a productive partnership between clients and the Atelier, we utilize a structured five-step working procedure. The complete details are available on our Process x Delivery page.

The Blueprint: The strategic result of our "Three-Point Framework" (Theme, Background, Style) analysis. Each project is created according to this foundational Blueprint.
The Prototypes/Mock-ups: These digital samples serve as visual guides for creating custom acrylic or oil on canvas paintings. Typically within one working week after receiving payment, we develop one to three custom prototypes/mock-ups for your selection.
The Digital Creative Project: A fully customized process tailored to client demand and engineered following a project consultation.

2. Timelines

Following traditional atelier methods, each painting is hand-painted in multiple layers of acrylic or oil on canvas. This artisan process requires dedicated time to achieve proper layering, texturing, and artistic depth.

The Creation: To ensure proper layering and structural integrity, each acrylic or oil on canvas painting requires 3–6 weeks of active work.
The Natural Drying: Following completion, this mandatory phase requires 1–3 weeks of drying time before the canvas can be safely rolled and packaged for delivery.
The Modifications: If refinements are requested, additional time will be required to ensure satisfactory results. Typically, we require an additional 3 working days to generate new prototypes/mock-ups or 1–2 weeks for physical artwork refinements.

3. Artistic Liberty x Technical Integrity

Following the principle of "80% Accuracy x 20% Creativity", we create each artwork as a balance of structural accuracy and artistic expression.

The Precision: Each acrylic or oil on canvas painting is uniquely handcrafted by an experienced artist. Therefore, slight variations in colors, brushstrokes, and likeness compared to your reference prototypes/mock-ups are natural signatures of the fine-art process and are not considered defects. Additionally, influenced by your environment's lighting and background wall colors, an acrylic or oil on canvas painting might appear slightly different in comparison to the photograph provided for approval before the natural drying process and delivery.
The Digital Preview: We utilize high-resolution digital previews for your approval. Please note that monitor calibrations, and camera settings (including built-in AI) can affect how colors appear on screens versus the physical canvas. We strive for accuracy, but minor tonal differences may exist between a digital draft and the real artwork.

4. Logistics x Global Delivery

To ensure a safe delivery, we partner with trustworthy logistics providers—including Canada Post, UPS, and Purolator.

The Rolled Canvas: To celebrate the liberty of choice and ensure safe transit, we exclusively deliver our custom acrylic or oil on canvas paintings as rolled canvases without frames. We believe our clients should have complete design autonomy to select custom framing that perfectly complements their unique interior while supporting local framing services.
The Packaging: To secure the structural integrity of the canvas during transit—especially for global shipments—we utilize a Double-Layer Protection method. The complete details are available on our Process x Delivery page.
The Tracking: A tracking number will be provided via email, allowing you to monitor your delivery in real-time.
Tax x Duty x Tariff: International clients serve as the "Importer of Record" for all shipments. We are not responsible for VAT, GST, Trade Tariffs, brokerage fees, or any import/export fees incurred during the original delivery or the return process.
The Carrier Liability: While we are not liable for delays, losses, or damages during transit, we fully support our clients in navigating carrier resolutions. Please notify us of any transit issues within 7 days of delivery with supporting evidence (e.g., photos of the damaged packaging and canvas).

5. Archival Care x Client Responsibility

Our methodology is built for longevity; many works from our international heritage remain in great condition after more than two decades. However, the long-term preservation is a shared responsibility.

Framing x Installation: Upon delivery, we strongly recommend professional framing and proper installation to safeguard the structural integrity of your canvas.
Preserve x Protect: To ensure the material’s longevity, we suggest following proper preservation methods. Exposure to extreme sunlight or high humidity might affect the acrylic or oil on canvas paintings. Any damage resulting from improper storage, framing, or environmental exposure during ownership is entirely the client’s responsibility.

6. Intellectual Property x Copyrights

We highly respect the work of fellow creators and strongly adhere to global copyright standards to protect the integrity of the creative industry.

The Atelier Rights: We retain the right to display all completed artworks and their active creation processes on our digital platforms (e.g., YouTube, X). If you prefer to keep your project private, please notify us at the beginning of the creation phase.
The Usages: Commissioned acrylic or oil on canvas paintings are intended for personal or commercial display. Clients retain the complete right to resell their physical artwork. However, modification or reproduction of Bespoke Fine Art is strictly prohibited without an explicit written consent from our Atelier.
The Client’s Responsibility: By providing reference images, the client certifies they hold all necessary rights, licenses, or permissions for creation and reproduction. The client assumes full responsibility for ensuring images belong to the public domain or are utilized within appropriate legal provisions. In the event of an intellectual property dispute regarding client-provided images, the client agrees to take full responsibility for any resulting legal fees, expenses, or damages.

7. Unforeseen Events x Collaborative Spirit

With decades of global experience, we are well-prepared for a wide range of challenges. However, unforeseen issues may arise. For any situation not covered within these terms, we maintain an open-door policy for a mutual resolution. We believe that any challenge can be resolved through clear communication and mutual respect. We are committed to working with you to find fair and productive solutions.

8. Dispute x Settlement

We are committed to resolving any issues through the spirit of "Win x Win". In the rare event of a disagreement, we suggest the following framework to resolve matters efficiently while preserving our productive relationship:

Governing Law: All agreements and interactions are governed by the laws of the Province of Nova Scotia and the federal laws of Canada.
Good-Faith Negotiation: Both parties agree to first attempt to resolve any dispute through direct, good-faith professional discussion within 30 days of the issue arising.
Voluntary Mediation: If negotiation is unsuccessful, we suggest seeking a collaborative solution via a neutral third-party mediator, such as professionals registered with the ADR Institute of Canada.
Final Jurisdiction: In the unpleasant event that a total disagreement occurs and formal legal action is unavoidable, both parties agree to the exclusive jurisdiction of the courts in Nova Scotia, which shall serve as the definitive venue for all disputes and settlements.

9. Cancellations x Returns x Refunds

To ensure fairness for both the client and our Atelier, all cancellations, returns, and refunds are governed by our dedicated Returns & Refunds Policy. By commissioning an acrylic or oil on canvas painting or a creative project, you acknowledge that you have reviewed our Returns & Refunds pages and agree to our Terms & Conditions.

10. Privacy x Data

We respect and protect our clients' privacy and data. We safeguard your personal information and creative assets according to the standards outlined in our page Privacy x Data.
