Terms and conditions are the agreements that outline the rules and guidelines for buying and using our products, services. They define the rights and responsibilities of both Heyda Inc. and the users, helping to protect both parties and clarify expectations.

1. Our Artwork

Instead of making exact-copy of the originals/samples, we follow the concept of “re-creation”, and we make each painting according to its required art technique. In addition, our artists follow the principal of "80% accuracy + 20% creativity" to make each painting with some degree of uniqueness even Masterpiece Recreation ones. Thus, our paintings are not photographic reproductions and differ slightly from the originals in size, brushstrokes, details, etc.

Each painting is hand-painted with several layers of oil/acrylic paint and each layer must reach a suitable level of dryness before the next layer can be applied. The paints used to create artworks, especially oil ones, are slow-drying paints, so the amount of time required for the paints drying greatly depends on humidity and weather. Thus, typically, creating a particular painting will take a period of 2-4 weeks of works, and then following by 1-2 weeks of the natural drying process before shipping.

2. Color & Likeness Disclaimer

Each painting is crafted with great care and attention to detail. Due to the handcrafted nature of our work:

- There may be slight variations in color or likeness compared to reference photos/samples or digital previews.

- These variations are a natural part of the artistic process and are not considered defects.

3. Digital prototype

Digital prototype is the sample that we creates digitally for each Portrait, Photo to painting, Creative artwork. Client will approve or request reasonable changes. The approved prototype will be used as samples to create the artworks.

 

The prototypes for Stylist/Creative Portraits and Creative artworks are our artistic creations. So to protect our intellectual property rights, we provide the digital prototype in a maximum size of 500x500 pixels.

4. Order Review Process

To ensure satisfaction, once a painting is completed, we will take photos of the painting and send it to client for approval. Client will approve or request reasonable adjustments according to the agreed sample. After receiving the client approval, we will put the artworks into a natural drying process.

5. Order cancellation

If the Client changes his/her mind about the order or is not satisfied with our digital prototypes provided after three adjustments, we will issue a full refund within 1 to 3 weeks. However, if the sample is confirmed and our artist begin working on the artwork (within 1 week after the sample confirmation), we will issue a partial refund as follow:
- Our Collection of Masterpiece Recreation : 100% delivery fee + 80% selling price
- Personalized Artworks - Public domain artworks : 100% delivery fee + 50% selling price
- Personalized Artworks - NOT public domain artworks : 100% delivery fee only
- Portraits : 100% delivery fee only

6. Return & Refund

Because of the customized nature of our products, we have specific policies in place regarding returns and refunds.

 

a. Portraits & Personalized Artworks

All portraits and personalized artworks are “made to order” and “uniquely tailored” to the buyer’s specifications. For this reason, we do not accept returns, exchanges, or cancellations once the photo of the completed painting is approved. Therefore, all portraits and personalized artworks are final sales, and we will not issue refunds, except Lost or Damaged products in transit.

 

b. Our Collection of Masterpiece Recreation

Although most of the paintings in Our Collection of Masterpiece Recreation are “made to order”, we will issue a partial refund minus delivery and restocking fees depend on the case.
- Selling price : Refund 80%
- Restocking fee : $50 CAD per painting
- Costs to ship the returned orders to Heyda Inc, Canada : Non-refundable

7. Lost and Damaged Products

All artworks are delivered with suitable packaging and by reliable logistic services such as Canada Post, Purolator, UPS, etc. However, occasionally, packages may be lost or damaged during transit, delivered to an incorrect address, etc. In the unlikely event that your package is lost or damaged upon arrival, please notify us within 7 days of delivery. We are not responsible for delays or loss caused by shipping carriers, but we will do our best to assist you with filing claims or tracking lost packages.

Please email us at art@heyda.ca with your Order confirmation number and clear photos of the damages or issues. We will assess the claim and, if valid, offer one of the following:

- A replacement (if possible)

- A partial or full refund according to our refund policies

- Store credit

8. Copyrights

We highly respect the work of fellow artists, the rightful ownership of the artworks as well as obey the Copyright Laws.

 

All sample of artworks on our website are either licensed or in public domain. In general, a work typically enters the public domain when its term of copyright expires.

 

In Canada, Copyright lasts for the life of the author, the remainder of the calendar year in which the author dies, and for 70 years following the end of that calendar year. Therefore, protection will expire at the end of the 70th calendar year after the author dies.

 

Before December 30, 2022 , the general term of protection was 50 years after the death of the author. On December 30, 2022 , this term was extended to 70 years after the death of the author. The extension of this term does not have the effect of reviving copyright in works for which protection expired prior to January 1, 2023.

 

For custom orders (portraits, artwork recreations, photo to painting, etc.), the client have to certify that they have the right to use and reproduce any provided images and that the client administer the right to reproduce them to us. On behalf the client, we create artworks based on images provided by the client. Responsibility to ensure that the images are in public domain, that their use is within fair use provisions or that any copyright permissions required have been granted, remains with the client. In case of legal disputes regarding intellectual property, the client will take full responsibilities that include but not limit to legal fees, compensation for damages, etc.
